Terms and Conditions
These terms and conditions ("Terms", "Agreement") are an agreement between the dress hire business ("Company", "us", "we", or "our") and you ("User", "you", "your", "customer").
This Agreement sets forth the general terms and conditions of your use of the dress hire services and any related products and services (collectively, "Services") offered by the Company.
A) “Garment” means all Garments supplied on hire by LUXX Hire to the Customer in accordance with these Terms.
B) “Event Date” means the date that the Customer provides to LUXX Hire for when they plan to wear the Garment.
C) “Hire Period” means the period that the Customer books the Garment for spanning from the scheduled pickup date (or the delivery date for hires being delivered by post) to the scheduled return due date (whether in store or by post).
D) “Hire Fee” means the cost of the hire of the Garment inclusive of GST. This does not include postage costs.
1. Dress Hire Agreement
1.1. By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Services.
1.2. Our Services allow you to rent dresses for a specified period, as agreed upon during the booking process. The agreed hire terms are 7 days. The hire begin when the dress arrives, meaning that the day your garment arrives is the first day of hire. On the 7th day, the garment must be posted back to us.
1.3) If you are between the ages of 13 and 17, you represent and warrant in favour of LUXX Hire that you have reviewed these Terms with your parent or legal guardian and that you and your parent or legal guardian understand these Terms. LUXX Hire will assume that this is the case and provide access to its services on this basis.
2. Booking and Payment
2.1. To book a garment, you must provide accurate and complete information. Any false information provided may result in the cancellation of your booking.
2.2. Payment is required at the time of booking. We accept various payment methods as listed on our website.
2.3. The rental fee covers the agreed rental period. Any extensions to the rental period must be agreed upon in advance and may be subject to additional fees.
3. Dress Delivery and Return
3.1. Garments will be delivered to the address provided by you at the time of booking. It is your responsibility to ensure that the delivery address is accurate and accessible.
3.2. You must return the dress to us by the agreed-upon return date. Late returns will be subject to fees.
3.3) As stated in section 1.2, the rental period is for a duration of 7 days. If the 7th day falls on a weekend day, the garment must be posted on Monday. When selecting a dress to hire, Customers must select the date 3 days prior to their event date so that LUXX Hire can ensure the garment is sent via express post and will arrive a day or 2 prior to your event. 3.4) Local returns: For local drop off, Customers are expected to return the item within opening hours. If the return date falls on a day that the LUXX Hire is closed, the Customer can return the following day.
3.5) Post Returns: For non-local Customers, or Customers posting garments after the hire, the garment must be posted on the fourth day in the return Express Post bag provided by LUXX Hire (unless otherwise agreed at the time of hire).
3.6) Customers must notify LUXX Hire immediately if there is a delay in returning the garment as future hires rely strictly on the garment being returned on time.
3.7) If Customers receive an item that is not as described, or faulty, customers are expected to contact LUXX Hire within 4 hours of receipt of the item and we will arrange exchange, or refund of the hire fee once the item is received back at the dress hire studio.
3.8) Late returns attract a Late fee of $20.00 late fee per day that the return is late, after the last day of booking. Late fees will be charged to the Customer credit card details that were provided at the time of booking.
3.9) If the Customer has not returned the rental garment/s within 14 days after the intended return date, LUXX Hire will consider the rental garment/s as non-returned and will charge the Customer's credit card 200% of the recommended retail value in addition to the rental cost that the Customer has already paid. The credit card on file will be charged and if unsuccessful, referred to a debt collection agency.
4. Postage
4.1) For all Garments that are to be delivered in either direction (to and/or from the Customer) a $15 postage charge per direction is payable by the Customer at the time that the booking is made.
4.2) If a postage charge cannot be successfully charged by LUXX Hire when due at time of booking, the hire may not proceed and the Hire Fee is not redeemable by the Customer.
4.3) Upon dispatch of the garment, the Customer will be notified of the Post tracking information via email.
4.4) LUXX Hire will select the signature on delivery option when posting garments to ensure the safety of the parcel. The Customer will not take steps to void the “signature on delivery” requirement for their parcel, for example by acceptance of the “leave in a safe place” option on the online tracking link. If the Customer breaches this term the Customer takes full responsibility for any loss of garment/s and will be liable to pay 150% of the RRP of the garment to LUXX Hire.
4.5) LUXX Hire will include a Prepaid parcel satchel in the original parcel. On the 7th day of hire, the Customer must use the Pre-paid satchel to return the garment. Luxx Hire ensures all fields are filled out on the parcel so that the Customer only has to fold the garment, put it inside the Pre-paid satchel, seal and post it back to LUXX Hire.
5. Cancellation, Exchanges and Refunds
5.1. LUXX Hire does not accept cancellations after a hire booking is made. We may be able to assist if you would like to change the type of garment you have booked if the new garment requested is available. Any garment that is priced higher than the original booking, will require the difference to be paid. Should the garment be less than the original booking, no refund of the difference will be given.
5.2. Refunds will not be provided at any time unless there is a fault in the dress upon delivery. This means that if the garment arrives and does not fit or suit you, we are unable to provide a refund. LUXX Hire is more than happy to assist with sizing advice and measurements to ensure you have picked the right dress for you!
6. Damages
6.1 You agree to treat our garments with the utmost of care.
6.2 Damages can be defined as the garment being ripped, torn, discoloured, altered in any way or changes in the garment such as size and colour due to the Customer attempting to wash the garment. If the garment has a strong smell of smoke after dry cleaning, this will also be defined as a damaged garment,
6.3. When hiring a garment through LUXX Hire, the Customer agrees that any damages incurred to the garment by the Customer will incur a fee. LUXX Hire will inspect the garment upon return delivery and contact the Customer regarding any defects or damages to the dress. The Customer will be liable to pay any costs associated with the damages. If the dress is deemed unwearable after the Customer returns the garment due to excess damage, the Customer will be responsible to pay 200% of the RRP of the garment. The credit card used to make the original booking will be charged.
7. Default & Collection
7.1) If the Customer owes LUXX Hire any money the Customer shall indemnify LUXX Hire from and against all costs and disbursements incurred by LUXX Dress Hire in recovering the debt (including but not limited to internal administration fees, legal costs on a solicitor and own client basis, LUXX Hire collection agency costs or associated administration charges, and bank dishonour fees).
7.2) If you do not pay the amounts owed to us when due we will pass on the invoices to a debt collection company to pursue you for collections, including and without limitation solicitor and collection fees. LUXX Hire reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.
8. Cleaning/Alteration
8.1 ) LUXX Hire manages the cleaning of Garments between hires. The Client agrees that they will not attempt to clean, iron, alter or repair the garment in any way.
8.2) If you receive a dress with slight creases, please try steaming the garment on low heat only.
8.3) We dry clean and inspect all products with the utmost of care, however use of this garment is at your own risk and LUXX Hire shall not be held liable for any health-related complaints associated with a product rented from our site. Our products have been worn by other consumers prior to your rental.
9. Customer Responsibilities
9.1) The Customer shall:
• Immediately notify LUXX Hire of any damage to the Garment that occurs during the Hire Period
• Not alter or interfere with the garment (including cutting off hanging ribbon or amending the length of garment – temporary or otherwise).
• Not apply self-tan within 48 hours before wearing the Garment (if a light coloured Garment)
• Keep the Garment in their own possession and control during the Hire Period.
10. Changes to Terms
8.1. We reserve the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new terms and conditions.
11. Governing Law
9.1. This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia without regard to its conflict of law provisions.

Privacy Policy
We collect your personal information such as your name, address, contact number and email address as well as your credit card details. LUXX Hire will never disclose or share any of your personal information unless you breach the terms and conditions. To which we would then disclose your personal information to a third party source for debt collection and recovery of monies loss to us.
